Constantino's Agenda To Make The Second Amendment Great Again

The right of the people to keep and bear arms shall not be infringed…

In Congress, I will fight to make the Second Amendment great again by repealing federal gun control, slashing unconstitutional regulations imposed by rogue agencies like the ATF, and ultimately restoring the right to keep and bear arms for all Americans.

Below are eight concrete steps that will help achieve that goal:

1. Pass Concealed Carry Reciprocity, or Preferably, National Constitutional Carry Legislation

The Second Amendment is a RIGHT, not a privilege. For far too long, anti-gun politicians have slapped restrictions on this right, particularly in states like New York, where carrying a firearm is so heavily restricted it is impractical for many, especially those who need it most, to defend themselves.

President Trump has already signaled he would sign Concealed Carry Reciprocity legislation (H.R.38, 118th Cong.), which would make any states’ concealed carry permit work effectively the same as a drivers license, requiring all other states to recognize it, therefore allowing New Yorkers to circumvent the current system by using another state’s permit.

Ultimately, I would like to see National Constitutional Carry (H.R. 9534, 118th Cong.), which allows all law-abiding citizens to carry a firearm without requiring government permission.

2. Overturn Joe Biden’s Executive Gun Control Measures

President Trump has already made ground doing so by eliminating Biden’s Office of Gun Violence Prevention. I would further support reinstating the Dickey Amendment, which prohibits the use of federal funds to advocate or promote gun control, to ensure any similar office cannot be revived by a future anti-gun president along with overturning Biden‘s “Zero Tolerance Policy” which revokes firearm retailers licenses for things such as simple clerical errors.

3. Rescind Rogue Anti-Gun Rulings by the ATF

This includes the ATF’s bans on homemade firearms, pistol braces, and forced-reset triggers. (ATF final rules 2021R-05F, 2021R-08F, 2018R–22F, and the ATF’s letter dated 3/22/22).

Passing legislation like the PISTOL Act (H.R.381, 118th Cong.) will prevent similar overreach from occurring in the future.

I will also fight to rescind the ATF’s “Engaged in the Business” Rule (Final Rule 2022R-17F), which arbitrarily broadened who is considered a firearms dealer.

4. Fight Back Against State-Level Tyranny

With some of the worst Second Amendment infringements being at the state level, I will consult with legal experts to find ways to fight back. 

New York in particular is plagued with some of the worst gun control schemes in America, including the SAFE Act and the so-called Concealed Carry Improvement Act.

With Gov. Kathy Hochul continuing to push the envelope, I will pursue all avenues to fight back, whether it be through legislation, the courts, or by empowering federal officials to take action.

5. Pass Legislation to Deregulate Suppressors

It is past time to remove the insane restrictions on firearm suppressors, which functionally serve only as a safety device to protect hearing.

Legislation like the SHUSH Act (S.4825, 118th Cong.) lifts their longstanding restrictions under the NFA and NICS system.

6. Oppose All Federal “Red Flag” Gun Confiscation Laws

“Red Flag” laws are a dangerous slap in the face to due process that empowers the government to seize firearms without proper legal proceedings. “Red Flag” laws have been abused on numerous occasions, most egregiously against law enforcement officers by the very criminals they have arrested and innocent citizens for simply being accused of being a risk to themselves or others.

Passing the Federal Agent Responsibility Act (H.R.1243, 118th Cong.) will hold any federal agent who participates in unconstitutionally gun grabs accountable.

7. Repeal the Federal Gun Tax

The Second Amendment is a right, not a privilege. Targeted taxes on firearms and ammunition are tantamount to poll taxes that have been thoroughly ruled as unconstitutional.

The Pittman-Robertson Act’s 11% excise tax on firearms, ammunition, and archery equipment is an unfair attack on lawful gun owners that must be repealed.

8. Abolish the ATF

While the ATF was established initially as a taxing authority within the Treasury Department, it has since become an unaccountable behemoth that has been weaponized by anti-gun radicals to restrict the rights of law-abiding gun owners. As Elon Musk and DOGE look for wasteful spending, the ATF should be at the top of their list.
